Terms of Sales

Orders are processed using approved credit card or pre-pay. To obtain 30-day billing, please contact our office. International customers must provide International UPS, DHL or Fed Ex account. Orders placed to ship within Massachusetts are subject to Massachusetts Sales Tax and the amount is based on local rates. Orders are processed according to prices in effect on date of order. Newton Distributing Company reserves the right to make changes without notice. No items or parts may be returned except with Return Material Authorization (RMA). Special service fees may be charged for Change Order, Rush Order, and Expedite and these fees are not refundable. All retail orders on this web site are payable by check or credit card. For wholesale orders, our terms are prepaid, C.O.D., or credit card or pre-established Terms (see above).

We accept MasterCard, Visa, Discover & American Express. Make checks payable to Newton Distributing Company. All returned checks will be charged accordingly.

ACCEPTANCE OF ORDER

Newton Distributing Company, Inc. will only accept orders placed within Newton Distributing Company, Inc.'s Terms and Conditions of Sale and within Newton Distributing Company, Inc.'s recognized and approved format. No change to the Order Quote or Purchase Order will be accepted without approval of Newton Distributing Company, Inc.'s authorized agent.

ASSISTANCE

Newton Distributing Company, Inc. offers solution choices and may provide technical suggestions or recommendations. Newton Distributing Company, Inc. does not guarantee that our recommendations meet precise needs. Customer is solely responsible for confirming data or to determine appropriate selection and to make final decisions.

CREDIT CARD PAYMENT

Newton Distributing Company, Inc. accepts MasterCard, Visa, Discover and American Express.

DROP SHIPMENTS

Product may be shipped direct to customer site from factory.

ERRORS

Any errors MUST be reported within20 working days of the date of invoice. After20 working days the invoice will be considered correct with the full amount due.

INTERNATIONAL SALES

(i) All orders are NCNR. (ii) Payable by Bank transfer to Newton Distributing Company, Inc. before shipment to customer. (iii) Add: $40 Bank Transfer fees (iv) Newton Distributing Company, Inc. offers open account credit to approved accounts. Payment for international orders may be done with bank transfers only. (v) Any order of international origin is subject to compliance with US Export Regulations.

NEW ACCOUNTS

Net 30 Days is available to credit approved companies. The minimum order requirement for opening a new account is $800. The initial order must be with a credit card or pre-paid with a check. Please allow a minimum of 15 days to open a new account.

WHOLESALE ACCOUNTS

Newton Distributing Company, Inc. is able to offer credit terms, please call 877.837.7745 for details. NCNR (International Only) Non-Cancelable, Non- Returnable. These are items that cannot be returned, once the order has been placed. Non-stock items are considered NCNR and may be subject to minimum order quantities and special charges.

OUT OF STOCK ITEMS

Items not available for immediate shipment will be shipped as soon as they are available. Those items not available at the end of 30 days will be cancelled and refunded/credited in cases of prepayment unless the customer authorizes otherwise. At the end of 90 days, orders for items not available will be canceled unless the customer authorizes otherwise.

PRICE QUOTATIONS

All written quotations are valid for 30 days from the day issued, unless otherwise specifically stated in writing. Quotations, after being accepted, will be subject to credit approval before shipment. Newton Distributing Company, Inc. reserves the right to correct errors.

PRICING

All prices are subject to change without notice. Newton Distributing Company, Inc. cannot control price changes nor quantity availability from manufacturer. All orders are subject to current pricing at the time of acceptance by Newton Distributing Company, Inc.

PRIVACY POLICY

Newton Distributing Company, Inc. does not sell or rent any names or information. Please refer to Newton Distributing Company, Inc.s Privacy Statement.

PRODUCT DEFECTS

Buyer must notify Newton Distributing Company, Inc. within 45 days from date of shipment of any defective product. Warranty returns are limited to repair, replacement or refund of purchase price actually paid for product. Newton Distributing Company, Inc. is not liable for defects of products from any manufacturers.

PRODUCT USAGE

Customer is solely responsible for safe and proper use of products purchased from Newton Distributing Company, Inc.

RETURNS

• Approved returns require an RMA# (Return Material Authorization Number).
• Returns are subject to a 15% re-stocking fee plus freight charges in and out.
• All return freight charges to be pre-paid.
• Approved returns of standard items will be accepted only within 30 days.
• Authorization of return or cancellation of order depends upon manufacturer's approval and terms. Date code sensitive product may not be returned.

SALES TAX

Open accounts for Massachusetts customers must have a Massachusetts sales tax exemption certificate on file with Newton Distributing Company, Inc. to avoid state sales tax charges. Unless otherwise noted, Massachusetts Sales Tax will always be charged. Non-taxable status is determined according to Massachusetts state law, and the customer is responsible for determining if tax is to be collected. State sales tax will be charged on all productcharges to Massachusetts locations, unless a signed official state tax exemption certificate is furnished to Newton Distributing Company, Inc. in advance of order acceptance.

SHIPMENT DAMAGE

Any claim must be made within 10 days of the date of shipment. External damage to shipment must be documented in writing, at time of delivery with carrier. Please unpack and inspect all shipments immediately upon receipt. If there is a problem, please notify the carrier immediately for inspection and documentation. Failure to identify damage will result in the carrier's refusing to honor the claim. For your protection, prepaid shipments include insurance for damage or loss in transit.

SHIPPING METHODS

Unless instructed otherwise, orders are shipped ground surface. Air shipment is available at an additional charge.

INTERNATIONAL SHIPMENTS

Freight will be charged to customer's shipping account only. There is no pre-pay and add to Invoice. Invoices are for product only and purchased only via bank transfer.
